1. Acceptance of These Terms

By downloading, installing, or using the Psychly mobile application (“Psychly”), provided by Tunahan Aktay (“we”, “our”, or “us”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, do not use Psychly.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to use Psychly.

3. License Grant

You may use the app on an Apple-branded device you own or control, subject to these Terms. These Terms supplement Apple’s Standard Licensed Application End User License Agreement. If the two conflict about your license to use the app, Apple’s agreement applies.

You may not copy, modify, reverse engineer, rent, lease, sell or sublicense the app or its content, except where applicable law or the relevant open-source license permits it.

4. Educational Use

Psychly offers psychology education and everyday wellbeing exercises: courses, articles, book summaries, stories of psychology experiments, meditation, visualization, breathing, a focus timer and a mood calendar.

The app is for learning and self-reflection. It is not medical or psychological advice, diagnosis or treatment, and it does not replace a psychologist, psychiatrist, doctor or therapist. Courses that describe disorders and therapies teach how the field works; they do not diagnose you or tell you how to treat a condition. The wellness score at the end of onboarding is a summary of your own answers, not a clinical measurement. Talk to a qualified professional about your mental health, and before you change or stop any treatment.

If you are in crisis or think you may harm yourself or someone else, contact your local emergency number or a crisis line in your country now. The app cannot respond to an emergency.

5. Subscriptions & Purchases

Without a subscription you can open the first three items of each course category and of the articles, experiments and book summaries, use the meditation, visualization, breathing and focus tools, and keep the mood calendar. A Premium subscription unlocks every course, article, experiment and book summary.

Prices, subscription periods and any offer terms are shown before purchase.

• In-App Purchases: Subscriptions are sold through Apple’s in-app purchase system. Apple handles all payments, taxes, and billing.
• Renewal & Cancellation: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple Account settings.
• Refunds: Apple handles all payments, so refunds are requested from Apple at reportaproblem.apple.com. We cannot issue refunds ourselves.

Nothing in these Terms removes rights you have under mandatory consumer law.

6. Intellectual Property

The app’s code, interface, courses, articles, summaries, audio, graphics and branding belong to Tunahan Aktay or their respective licensors. Book summaries describe works that belong to their authors and publishers, and do not replace them. Videos the app links to belong to their creators and open in the service that hosts them.

7. User Conduct

You agree not to:

• Copy, republish or sell the app’s content outside the app.
• Disrupt or exploit the app.
• Violate applicable laws or third-party rights.

8. Disclaimers

The app is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, or that its content is complete, current or suited to your situation. Mandatory consumer rights remain unaffected.

The Imagine exercise flashes the screen and is not recommended if you have epilepsy or are sensitive to flashing light. Stop any breathing or meditation exercise that makes you dizzy or uncomfortable.

9. Limitation of Liability

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, including decisions you make based on the app’s content, and our total liability is limited to the amount you paid for Psychly in the 12 months before the claim. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited by law.

10. Privacy

Your privacy is important. Please read our Privacy Policy to understand how we collect, use, and protect your data. It forms part of these Terms.

11. Termination

• By You: You may stop using Psychly at any time.
• By Us: We may suspend or terminate your access if you violate these Terms or misuse the app.
• Effect: Certain clauses (Educational Use, Intellectual Property, Disclaimers, Liability) will survive termination.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Turkey. You agree to resolve any disputes through the courts of Turkey, unless local consumer protection laws offer you additional rights.

13. Changes to the Terms

We may update these Terms. We will announce significant changes on this page or in the app before they take effect, and update the date above.

14. Miscellaneous

These Terms, the Privacy Policy and Apple’s Standard EULA form the entire agreement between you and us. If any part is found invalid, the rest remains enforceable. You may not transfer these Terms without our permission.
